Special Council Meeting

That Council move in-camera in accordance with Procedure By-law # 8081-24, Closed Meeting Policy G 040, and the Municipal Act, 2001, Section 239 (2)(b) personal matters about an identifiable individual, including municipal or local board employees, (e) litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board, and (f) advice that is subject to solicitor-client privilege, including communications necessary for that purpose.

That Council rise from the closed portion of the meeting.

That Council delegate authority to the Chief Administrative Officer (CAO) to undertake all necessary actions to indemnify the respondents in accordance with the Town of Whitby Indemnification By-law No. 5625-05 with respect to Human Rights Tribunal of Ontario (HRTO) file number 2025-63574-I and any related or subsequent matters before the HRTO arising from the same circumstances, including but not limited to the determination of retaining independent legal counsel for an individual, as well as the retention of and direction to external legal counsel.

That leave be granted to introduce a by-law and to dispense with the reading of the by-law by the Clerk to confirm the proceedings of the Council of the Town of Whitby at its special meeting held on November 27, 2025 at 5:30 p.m. and the same be considered read and passed and that the Mayor and the Clerk sign the same and the Seal of the Corporation be thereto affixed.
