Special Council Meeting

That Council move in-camera in accordance with Procedure By-law # 7462-18, Closed Meeting Policy G 040, and the Municipal Act, 2001, Section 239 (2)(c) a proposed or pending acquisition or disposition of land by the municipality or local board.

That Council rise from the closed portion of the meeting.

That the Commissioners of Financial Services/Treasurer and Legal and Enforcement Services/Town Solicitor be authorized to execute a five- year lease, with an option to extend for an additional five years, with Port Whitby Marine Supplies (or a related person/legal entity) for the South building located at 1710 Charles Street subject to terms outlined in Report FS 36-22 and such other terms satisfactory to the Commissioners of Community Services, of Financial Services/Treasurer and Legal and Enforcement Services/Town Solicitor.

1. That between one (1) to two (2) acres of the North-West portion of Part of 24, Concession 1, being part of PIN 26488-0153 (LT), the precise area of which shall be identified on a new Reference Plan to the satisfaction of the Commissioners of Financial Services/Treasurer and Legal and Enforcement Services/Town Solicitor, be declared surplus for the purpose of a sale to Town Brewery Inc., or its associated company, subject to the conditions as outlined in Report FS 38-22; 2. That the Town provide public notice in accordance with Town Policy F 190 regarding the Acquisition, Sale or Other Disposition of Land Policy and mail a notification to residents on Prentice Drive and Hyland Street adjacent to the land; Page 3 of 5 Special Council Minutes June 13, 2022 - 5:30 PM 3. That, provided no written objection is received by the Town Clerk in connection with the declaration of surplus, a by-law be brought forward to authorize the conveyance of land to Town Brewery Inc., or its associated company; and, 4. That the Mayor and Clerk be authorized to execute the Agreement of Purchase and Sale in Attachment B to report FS 38-22 between the Town of Whitby and Town Brewery Inc. and the necessary documents to give effect thereto.

1. That staff be authorized to negotiate the acquisition of property for the White Bridge capital project as outlined in Confidential Report FS 47-22; 2. That Chief Administrative Officer and Treasurer be authorized to execute Agreements of Purchase and Sale, including agreements made pursuant to Section 30 of the Expropriations Act, R.S.O. 1990, c. E.26, for properties noted in Confidential Report FS 47- 22, subject to terms acceptable to the Town Solicitor; and, 3. That staff be authorized to initiate an expropriation process for the property required for the White Bridge capital project, if required to maintain project timelines, for the acquisition of all property required for the White Bridge capital project, as outlined in Confidential Report FS 47-22.

That the meeting adjourn.

That leave be granted to introduce a by-law and to dispense with the reading of the by-law by the Clerk to confirm the proceedings of the Council of the Town of Whitby at its special meeting held on June 13, 2022 and the same be considered read and passed and that the Mayor and the Clerk sign the same and the Seal of the Corporation be thereto affixed.
